Foxcapital’s KSh 146 Billion Dispute With KCB: Claims and Court Updates

Foxcapital Investment Limited sued KCB Bank over a foreign remittance it says was sent for credit to its account but was not made available. The claim concerns approximately €976.7 million, reported at the time as about KSh 146 billion. KCB disputes Foxcapital’s account and has challenged documents relied on by the company. The court has not made a final finding that the money was received, withheld or that any document was forged.

What each side says

Foxcapital’s court claim says the funds were transmitted through UBS Switzerland AG in late 2025 and should have been credited to its account at KCB. KCB denies receiving or holding the remittance and has asked investigators to examine documents filed in support of the claim. Those are opposing claims in an unresolved commercial dispute.

In August, the High Court issued interim orders preserving the disputed sum while it considered the parties’ applications. Citizen Digital reported that the orders were extended to a hearing listed for September 17. The interim orders did not determine the merits of the case.

Latest reported court development

On September 17, 2026, the High Court allowed Nyachoti & Company Advocates to stop representing Foxcapital and gave the company 14 days to regularise its legal representation, the Daily Nation reported. The matter was listed for further directions on October 27. This procedural development does not decide the underlying dispute or establish the status of every interim order after that date.

Because the case remained unresolved in the reporting available by October 9, this article does not describe the matter as proven fraud. It reports the parties’ claims as allegations and the court’s interim steps as provisional.
