Rosemary Chemutai Burial Dispute Ends After Husband Withdraws Court Case

A Milimani court allowed Kelvin Migwe Kimwatu to withdraw his cases over the burial of his wife, Rosemary Chemutai Koech Kimwatu, on August 31, 2026. The withdrawal ended the pending burial dispute without a final ruling on every disagreement between the family members.
The interim order and the burial
Kimwatu had asked the court to involve him in decisions about his wife’s funeral and burial. The court issued temporary orders concerning the removal and burial of Rosemary’s remains while the dispute was pending. She was later buried in Kericho County before the case returned to court.
Why the case was withdrawn
On August 31, Kimwatu’s lawyer told the court he would not pursue exhumation or contempt proceedings and sought to withdraw the suit. Reporting from the hearing said he hoped to visit the gravesite and move toward reconciliation with the family. The court allowed the withdrawal with no order for costs.
The withdrawal closed the court case; it was not a judgment deciding all the parties’ earlier claims. The temporary order and the later events should be reported as separate stages of the dispute.
