Former Nairobi PC Davis Chelogoi Convicted in KSh 1.35 Billion Land Fraud Case

NAIROBI, October 16, 2026 — Former Nairobi Provincial Commissioner Davis Nathan Chelogoi has been convicted on five counts in a land fraud case involving a 7.39-hectare property in Lower Kabete valued at approximately KSh 1.35 billion.

Milimani Chief Magistrate Dolphina Alego found him guilty of conspiracy to defraud, forcible detainer, two counts of forgery and uttering a forged document after evaluating testimony and documentary evidence presented during the trial.

The court cancelled Chelogoi’s bond and ordered his remand at Nairobi Remand Prison ahead of mitigation and sentencing scheduled for November 2, 2026.

Dispute Over Lower Kabete Property

The proceedings arose from competing claims to land along Lower Kabete Road involving businessmen Ashok Rupshi Shah and Hitenkumar Amritlal Raja. The businessmen maintained that the property belonged to them and contested documents used to register it in Chelogoi’s name.

The dispute had previously been considered by the Environment and Land Court, which recognised the businessmen’s ownership in a 2022 judgment.

Chelogoi defended his claim by saying that the land had been allocated to him in 1995 during the administration of former President Daniel arap Moi. He argued that his public-service responsibilities contributed to delays in formalising the ownership documents.

Land Records and Forged Documents

Prosecutors presented evidence concerning a letter of allotment dated January 31, 1995, purportedly issued by the Commissioner of Lands. The criminal court found that the document was forged.

The trial also examined documents presented at the Directorate of Criminal Investigations headquarters in October 2023. Evidence challenged the authenticity of signatures and official stamps attached to records supporting Chelogoi’s land claim.

During the proceedings, the prosecution called 19 witnesses, including officials from the lands department and experts familiar with property records and document examination.

According to reports of the ruling, the court found that the prosecution had established the five charges against Chelogoi beyond reasonable doubt.

Co-Accused Andrew Kirungu Acquitted

The court acquitted former Assistant Deputy Director of Lands Administration Andrew Aseri Kirungu, who had faced charges connected to the processing of records for the disputed property.

Magistrate Alego found that the prosecution had not sufficiently demonstrated Kirungu’s criminal involvement. The court considered gaps in administrative records and the lack of proof that he knowingly participated in the alleged fraud.

His acquittal means the two accused received different outcomes despite being tried in connection with the same property dispute.

Land Registry Directed to Cancel Parallel Titles

The magistrate also directed land registration authorities to cancel parallel titles and related registrations issued over the disputed property.

The order addresses the conflicting land records at the centre of the case and follows the court’s findings on the fraudulent documents.

Sentencing Set for November 2

With his bond cancelled, Chelogoi will remain in custody pending mitigation and sentencing on November 2, 2026, according to reports by Kenya Broadcasting Corporation and The Standard.

The conviction is an important stage in the protracted legal dispute, although sentencing and any subsequent legal proceedings remain separate matters.
