
Kenya’s Birth and Death Registration Law: What the 2026 Amendment Changes

Kenya changed its civil-registration law in February 2026 to require at least one births and deaths registration office in every sub-county, a move intended to bring services closer to residents.
What Changed?
The Births and Deaths Registration (Amendment) Bill, 2024 was sponsored by Gilgil MP Martha Wangari and was assented to on February 19, 2026, according to the National Assembly’s Bills Tracker.
The amendment provides a legal basis for establishing at least one births and deaths registration office in every sub-county rather than relying on a smaller network that can require residents to travel long distances for civil-registration services.
Why Birth Registration Matters
A birth certificate is commonly needed for school registration, identity-document processes and other public services. Easier physical access to registration offices can therefore reduce travel and administrative barriers, particularly in rural or underserved areas.
Why Death Registration Matters
Death registration creates an official civil record that can be needed for estate administration, insurance claims and other legal or administrative processes. Accurate registration data also helps government agencies understand population trends.
Does the Law Mean Every Office Is Already Operational?
No. A legal requirement and full physical implementation are not the same thing. The amendment establishes the framework, but opening, staffing and equipping offices across all sub-counties requires administrative implementation.
Readers should therefore confirm the nearest operational Civil Registration Services office before travelling rather than assuming a new office is already open in every sub-county.
